Foster family, family-type orphanage (FTO) are forms of professional family care for children left without parental care, temporarily arranged in families.

Adoptive parents, parents-educators of FTO are citizens hired by the department of education to perform duties for the care, upbringing in their families of children left without parental care, on the basis of urgent employment contracts. Foster parents and parent-educators receive wages for the work of raising children accepted into their families. Up to 4 children are placed in a foster family, in FTO from 5 to 10 children.

The issues of creation and functioning of a foster family and a family-type orphanage are regulated by the Regulations on foster family and FTO,  approved by Resolutions of the Council of Ministers of the Republic of Belarus of 28.10.1999 No. 1678 and of 28.02.2006 No. 289, respectively.

For children who have lost their families, placement in foster families and FTO is an opportunity:

- to exercise their right to upbringing in the family regardless of age, state of health, negative life experience, developmental disabilities, behavior and legal status;

- not to lose family ties and the opportunity to communicate with siblings;

- to live and be brought up in their city, district, continue to attend the same kindergarten, school, vocational school, etc.;

- communicate with biological parents and close relatives (grandmothers, grandfathers), if it does not contradict the interests of children;

- to socialize more successfully in society;

- to become adopted (if there is a legal status);

- to receive timely protection of their rights and legitimate interests.

Who can become a foster parent, a parent-educator of FTO.

Foster parents, parents-educators of a family-type orphanage can be capable persons of both sexes, except:

persons with chronic alcoholism, drug addiction, substance abuse;

persons who, for health reasons, cannot be foster parents, parents-educators of a family-type orphanage, a children's village (town);

persons deprived of parental rights;

former adoptive parents, if the adoption was canceled due to improper performance by the adoptive parent of his duties;

persons suspended from the duties of a guardian or custodian for improper performance of the duties assigned to them;

persons with a criminal record, as well as persons convicted of premeditated grave or especially grave crimes against a person;

persons whose children have been recognized as in need of state protection in connection with the failure or improper performance by these persons of their duties for the upbringing and maintenance of children;

persons deprived of the right to engage in pedagogical activities or not having the right to engage in pedagogical activities in cases provided for by legislative acts of the Republic of Belarus.

Persons who have mastered the relevant educational programs of training courses of additional adult education are appointed to the positions of foster parents, parents-educators of a family-type orphanage. Selection of foster parents, parents-educators of a family-type orphanage is carried out by the guardianship and custody authorities.

It is welcomed that candidates for foster parents, parents-educators have pedagogical, psychological, medical education, as well as positive experience in the upbringing and socialization of native and adopted children. It is important that the candidate is set up for self-development, improving the professional level and parental competence.

Foster parents, parents-educators cannot be close relatives of children - brothers, sisters, grandfather, grandmother, and the parent-educator cannot be citizens under 25 years of age.

How to become a foster parent, a parent-educator of FTO.

If you want to become a foster parent, a parent-educator FTO must:

Step 1. submit to the Department of Education at the place of residence:

- application.

- passport or other document certifying the identity of the candidate for foster parents, parents-educators of FTO;

- marriage certificate - if the candidate for adoptive parents, parents-educators of FTO is married;

- medical certificates on the state of health of the candidate for foster parents, parents-educators, as well as family members of the candidate for foster parents;

- written consents of adult family members of the candidate for foster parents, parents-educators of the FTO living together with him, for the transfer of the child (children);

- information about income for the previous year.

Step 2. The Department of Education within 5 days from the date of your appeal requests from the competent authorities the necessary information about you (requests are sent to the Department of Internal Affairs, the court). Specialists of the Department of Education will examine the conditions of your life, study the personal characteristics, way and traditions of the family, interpersonal relationships in the family, assess the readiness of all family members to meet the basic life needs of children, which will be reflected in the act of examination of living conditions  candidates for foster parents, parents - educators.

Step 3

The Department of Education organizes for candidates for fosterparents, parents-educators of the FTO conducting training courses (lectures, thematic seminars, workshops, trainings) aimed at forming competencies in solving issues of protecting the rights and legitimate interests of receiving children (hereinafter - training courses). Mastering the educational program of training courses is a prerequisite for consideration by the guardianship authority of the issue of transferring children to the foster care family and FTO.

Step 4.

Candidates for foster parents, parents-educators who have passed training courses and received a certificate of training can be acquainted with the terms of the employment contract, the contract on the conditions of upbringing and maintenance of children.

Step 5.

The Department of Education provides candidates for foster parents with information about children who can be transferred for upbringing to a foster family in the district and issues a direction for acquaintance with them. You can get acquainted with the children for whom the referral is issued in the institution where they are located - in the hospital, children's home, orphanage, social and pedagogical center, boarding school or other institution located on the territory of your district.

Candidates for parent-educators who have a dwelling that provides at least 15 square meters per family member and pupil are provided with information about children who can be transferred to the FTO in the district for upbringing, and a referral is issued to get acquainted with them.

If there is no dwelling necessary for the creation of the FTO, the Department of Education informs candidates for parents-educators about the possibility of participating in the competition for the position of parent-educator, if there is a dwelling in the city (district) for the creation of the FTO. Candidates for parents-educators who have successfully passed the competition receive a referral from the Department of Education to get acquainted with children.

Step 6.

After the local executive and administrative bodies make decisions on the transfer of the child (children) to a foster family, the creation of a family-type orphanage, Department of Education concludes an agreement with the adoptive parent and the parent-educator on the conditions of upbringing and maintenance of children and an employment contract. The term of the employment contract depends on the period for which the child is transferred to the adoptive parent, the parent-educator. From this moment you become a member of the employment contract. the staff of the Department of Education. - persons suspended from the duties of a guardian or custodian for improper performance of the duties assigned to them;

- persons with a criminal record, as well as persons convicted of premeditated grave or especially grave crimes against a person;

- persons whose children have been recognized as in need of state protection in connection with the failure or improper performance by these persons of their duties for the upbringing and support of children;

- persons deprived of the right to engage in pedagogical activities or not having the right to engage in pedagogical activities in cases provided for by legislative acts of the Republic of Belarus.

Persons who have mastered the relevant educational programs of training courses for additional adult education are appointed to the positions of foster parents. Selection of foster parents is carried out by the guardianship and custody authorities.

If there are several persons wishing to accept the same child for upbringing in a foster family, the preferential right is granted to relatives of orphans, children left without parental care.

It is not allowed to conclude an employment contract with close relatives of the child (children) - with brothers, sisters, grandfather, grandmother.

 

The official duties of foster parents, parents-educators are established by the Resolution of the Ministry of Labor and Social Protection of the Republic of Belarus of October 21, 2011 No. 105 "On Amendments to Issue 28 of the Unified Qualification Directory of Employee Positions".

FOSTER PARENT (PARENT-EDUCATOR)

Job responsibilities: Accepts into their family, children left without parental care, who could not be set up for adoption or in the family of close relatives under guardianship. Carries out adaptation in a foster family, a family-type orphanage, a children's village, the town of a child left without parental care. Plans and carries out educational work, psychological rehabilitation, protection of the rights and legitimate interests of the child taken for upbringing. Studies their individual characteristics, interests, inclinations. Provides full mental and physical development, the formation of their personality. Creates conditions for the development of creative abilities of the child, their cognitive interests, physical training. Organizes the correction of the errors in the psychophysical development of the child. It helps to overcome the negative life experience of the child on the basis of studying the history of their development and upbringing. Conducts purposeful work on the correction of behavior, the emotional aspect of the child's personality, overcoming bad habits. Forms a child's positive experience of life in the family, ideas about the peculiarities of behavior and functions of all family members. Prepares the child for socialization in society, develops his independence, forms communication skills in society. Organizes the child's education in accordance with their capabilities and desire. Assists the child in obtaining education. Carries out on a voluntary basis the duties of a guardian, a custodian for cohabitation with the child and the satisfaction of their basic life needs: provides care for the child and their safety, prepares food, acquires the necessary things and products for the child, etc.; organizes control over the health of the child and the provision of necessary medical care; organizes communication of the child with brothers, sisters, parents, other members of his family. Carries out guardianship over property belonging to the child, if the guardianship and custody authority has not appointed a guardian over the property; protects the rights of the child and represents their interests in any bodies.

Must know: normative legal acts and other methodological materials in the field of education, children's rights; normative legal acts in the field of protection of property, housing, alimony, hereditary rights of orphans and children left without parental care, disabled children; pedagogical, psychological, mental characteristics of children left without parental care; achievements of pedagogical science and best practices in the field of upbringing and socialization of orphans and children,  left without parental care; fundamentals of labor legislation.

Qualification requirements: Secondary special (general secondary) education, training according to the educational program of training courses.

 

 

To create a foster family, you need to contact the guardianship and custody authority at the place of your residence with the following documents (Decree of the President of the Republic of Belarus of April 26, 2010 No. 200 "On Administrative Procedures Carried Out by State Bodies and Other Organizations at the Request of Citizens"):

- application,

- passport or other document certifying the identity of the candidate for foster parents,

- marriage certificate - if the candidate for adoptive parents is married,

- medical certificates on the state of health of the candidate for foster parents, as well as family members of the candidate for foster parents,

- written consent of adult family members of the candidate for foster parents living together with him, for the transfer of the child (children) to the family,

- information on income for the previous transfer of the child (children) to a foster family year.

The guardianship and custody authorities conduct a survey of the living conditions of candidates for foster parents, study their personal characteristics, way of life and traditions of the family, interpersonal relationships in the family, assess the readiness of all family members to meet the basic life needs of foster children and ensure the protection of their rights and legitimate interests, which is reflected in the act of examining the living conditions of candidates for foster parents.  First of all, children are transferred for upbringing to full families that have a constant source of income and conditions for the joint upbringing of brothers and sisters.

The guardianship authority shall request the following documents and (or) information from the relevant bodies and organizations:

- a copy of the document confirming the ownership of candidates for adoptive parents for a dwelling or the right to use a dwelling;

- certificates of the place of work, service and position of candidates for adoptive parents;

- information on income;

- information on the absence of a criminal record of candidates for foster parents, as well as adult family members living with them, as well as whether candidates for foster parents and adult family members living together with them have been convicted for premeditated grave and especially grave crimes against a person;

- information on whether candidates for adoptive parents were deprived of parental rights, whether adoption was previously canceled in respect of them, whether they were recognized as incapacitated or partially capable;

- information on whether the children of candidates for foster parents were recognized as in need of state protection, whether candidates for adoptive parents were removed from the duties of a guardian, a trustee for improper performance of the duties assigned to them.

If you wish to adopt children for upbringing in a foster family, then you will also need to undergo appropriate training (training), including knowledge of the functioning of foster families, the development of skills and abilities to meet the basic life needs of foster children, the preparation of foster children for independent life, the organization of social, medical, pedagogical and psychological correction of the problems of foster children.

Upon completion of the development of the educational program of training courses, the Department of Education acquaints candidates for foster parents with the terms of the employment contract, the agreement on the conditions of upbringing and maintenance of children, provides them with information about children who can be transferred for upbringing to a foster family in the territory of the district (city), and issues a direction for visiting these children at their place of residence (location) and acquaintance with them.

After acquaintance with the child (children), candidates for foster parents apply to the Department of Education with an application to the guardianship and custody authority for the transfer of a specific child (children) to them for upbringing.

In the decision to establish a foster family, the guardianship and custody authority shall indicate information about the child (children) who is transferred for upbringing to a foster family, establish monthly cash payments for the maintenance of the child (children), instruct the Department of Education to conclude an agreement (contracts) on the conditions of upbringing and maintenance of children and an employment contract.

 

Children are transferred to foster care, including those who are being brought up in children's homes, social and pedagogical institutions, boarding schools for orphans and children left without parental care, auxiliary boarding schools, special boarding schools, boarding schools for disabled children with psychophysical development and other children's boarding schools, vocational, secondary special, higher education institutions. The transfer of children to a foster family is carried out taking into account their desire, and upon reaching the age of ten years - only with their consent.

Siblings are usually placed in foster care.

From one to four orphans and children left without parental care (hereinafter referred to as children) are transferred to a foster family for upbringing, taking into account children over whom guardianship (custody) is established by one of the spouses, including the arrangement of newly identified brothers and sisters of a foster child (children) who have lost parental care.

If it is impossible to place brothers and sisters in one foster family, children can be transferred for upbringing to foster families living at a distance that allows for constant communication of foster children, the adoptive parent must oblige to ensure their regular communication.

Children with special needs of psychophysical development, disabled children, children under the age of three years are transferred to a foster family only if there are necessary conditions in the family.

The total number of children in a foster family, including relatives and adopted children, as a rule, should not exceed 4 people.

What documents are transferred to the adoptive parent together with the child?

For each child transferred to a foster family, the guardianship and custody authority or the administration of an educational institution, health care organization, social service organization shall transfer the following documents to foster parents:

child's birth certificate;

a medical certificate on the state of health of a child transferred to a foster family for upbringing;

document on training (education) - for children receiving general secondary education;

documents confirming the legal grounds for transferring a child for upbringing to a foster family (death certificate of the parent (parents), a copy of the court decision on deprivation of parental rights of the parent (parents), recognition of the parents as incapacitated, missing or dead, an act of the internal affairs body on the discovery of an abandoned child and others);

information about the presence of brothers and sisters and their whereabouts;

an inventory of the property belonging to the child, and information about the persons responsible for its safety;

a document confirming the presence of the child in the ownership and (or) possession and use of residential premises;

other documents available in the child's personal file.

Documents are transferred directly to the adoptive parents under the act no later than the day of conclusion of the agreement on the conditions of upbringing and maintenance of children.

Very important is the issue of material support for a child adopted for upbringing in a foster family.

For the maintenance of each adopted child, monthly funds are paid for food, the purchase of clothes, shoes, soft equipment, the amount of which is established by the Government of the Republic of Belarus (for more details, see Chapter 3 of the Regulations on the Conditions and Procedure for Providing State Support to Orphans, Children Left Without Parental Care, Persons from among Orphans and Children Left Without Parental Care, Children In Institutions Carrying Out Prevention No. 840 of 6 July 2006 approved by the Council of Ministers of the Republic of Belarus approved by the Council of Ministers of 6 July 2006 on State support for orphans, children left without parental care.

When transferring a disabled child or a child whose parents have died (recognized in court as dead, missing) for upbringing, foster parents are simultaneously transferred a pension certificate and the procedure for applying for the payment of a pension to the district (city) department for labor, employment and social protection at the place of residence of the foster family is explained. If the pension for disability or on the occasion of the loss of the breadwinner was not assigned, then the adopted parents are transferred the available documents confirming the right to a pension (documents on the length of service and the amount of the parents' salary, the conclusion of the medical and rehabilitation expert commission on the establishment of disability for the child, and others), and the procedure for applying to the district (city) department for labor, employment and social protection with an application for a pension is explained.

In the presence of medical and social indications, a copy of the doctor's prescription (conclusion of the medical advisory commission) and payment documents (payment documents), the Department of Education on the basis of the application of the adoptive parent petitions the local Council of Deputies to pay the adoptive parent funds for the purchase of medicines, medical products or technical means of social rehabilitation for the adopted child (children).

The conditions of remuneration of foster parents, depending on the number of children taken into care, their age and the presence of their features of psychophysical development, are established by the Ministry of Labor and Social Protection.

If a foster family pupil has reached the age of majority before completing his studies in an institution of general secondary or special education, monthly cash payments for maintenance shall be made until the completion of training and the issue of enrolling him in an institution of vocational, secondary special or higher education or before his employment (registration in the bodies for labor, employment and social protection), but not more than three months from the date of graduation.

Control over the expenditure of funds and management of the property of the adopted child, including residential premises, is carried out by the Department of Education.

Property acquired for a foster family at the expense of the budget is accepted on the balance sheet by the Department of Education. Adoptive parents are obliged to ensure the safety of this property and property belonging to foster children.

In case of early termination or after the expiration of the employment contract, the property acquired for the foster family at the expense of budget funds is transferred to the Department of Education.

 

Foster parents in relation to the foster child (children) have the rights and duties of a guardian, custodian (for more details see Art. 157-166 of the Code of the Republic of Belarus on Marriage and Family).

The Department of Education within five days from the date of conclusion of the agreement on the conditions of upbringing and support of children for each foster child shall issue to each foster parent a certificate for the right to represent the interests of the ward.

Foster parents have the right to:

- place children in educational institutions for pre-school and special education (without accommodation) on a general basis;

- to apply to the Department of Education for the placement of their foster children for the period of their absence on the grounds established by the legislation of the Republic of Belarus on labor, in another foster family, a family-type orphanage, with which their family has developed friendly relations;

- on labor leave according to the schedule of labor leave, compiled by the department of education, which has concluded an employment contract with them. During the absence in the family of a foster parent who has concluded an employment contract, or the absence of an opportunity to perform official duties on the grounds established by the legislation of the Republic of Belarus on labor (business trip, training courses, temporary disability, labor leave, etc.), upbringing, care and supervision of the foster child (children) is provided by the second foster parent within the framework of the duties of a guardian (custodian) or, upon his application, by the department of education shall ensure the placement of a foster child (children) for upbringing in another foster family, a family-type orphanage, a socio-pedagogical institution or in an educational and health institution of education. When a child (children) is placed in another foster family, a family-type orphanage, an agreement is concluded on the conditions for the upbringing and support of the child (children) between the department of education and the foster parents (parents-educators) who accept the child (children) for the period of absence of the parent parents who are his legal representatives, the opportunity to fulfill the agreement on the conditions of upbringing and maintenance of the child (children). A foster parent who is absent from the family on the grounds established by the legislation of the Republic of Belarus on labor shall transfer to the foster parent, the parent-educator temporarily accepting the child (children) for upbringing, the funds for its maintenance in proportion to the days of stay of each child in another foster family, a family-type orphanage, a children's one;

- to improve their qualifications in accordance with the procedure established for pedagogical workers of the education system.

Foster parents are obliged to:

- live together with foster children;

- provide foster children with living conditions that meet sanitary and epidemiological requirements (a separate room or part of it, a separate bed, a workplace, a place for games);

- provide care for foster children, joint life and leisure, supervision of their behavior and lifestyle;

- Organize medical examinations and treatment in accordance with medical indications, recommendations and the state of health of children.

- to carry out the upbringing of foster children, ensuring their moral and physical development, creating the necessary conditions for their education, preparing foster children for independent life, protecting their rights and legitimate interests in accordance with the development plan of the foster family (drawn up by the guardianship authority).

- To ensure that the child receives education in the forms prescribed by the legislation of the Republic of Belarus in the form available to the child in case of impossibility of the child's attendance at the institution of general secondary education for health reasons;

- to accept a foster child (children) brought up in another foster family (family-type orphanage) during the absence of his foster parents (parents-educators) to fulfill the agreement on the conditions of upbringing and support of the child (children) in connection with the leave or on other grounds established by the legislation of the Republic of Belarus (if less than 4 children are brought up in his family);

- prepare the child for communication with parents and other relatives and ensure this communication;

- to organize communication of the child with candidates for foster parents who have received a referral to get acquainted with the child in the manner prescribed by the legislation of the Republic of Belarus, by prior agreement with them on the time and place of meeting with the child;

- not to prevent the adoption of foster children by other persons.

Are the living conditions, upbringing and education of children in foster families monitored?

Control over the upbringing, education, satisfaction of the basic life needs of foster children, their preparation for independent life, the implementation by foster parents of the agreement on the conditions of upbringing and support of children and the development plan for the foster family is carried out:

in the first three months of upbringing of each foster child - at least once a week;

after the first three months of education and up to one year - at least once a month;

in the second and subsequent years of raising a child - at least once a quarter.

Forms of monitoring (conversations with teachers of foster children, foster parents, children, including by phone, meetings with a foster family, visiting a foster family at home, etc.) and the monitoring procedure are determined by an agreement on the conditions of upbringing and maintenance of children.

In which organizations, institutions can a foster parent apply for psychological, legal, pedagogical assistance?

In each district there are socio-pedagogical institutions - SPU - socio-pedagogical centers and children's shelters), which carry out psychological, pedagogical and socio-pedagogical support for families who have foster orphans, children left without parental care.

In addition, for foster parents, departments of education organize and conduct methodical associations, participation in which is mandatory, as it is a form of continuous professional development of foster parents. At methodical associations (pedagogical councils, colloquiums, seminars, trainings), the foster parent receives assistance in solving a number of pressing issues and problems of a psychological, pedagogical and legal nature.

Information about the SPU and the dates of methodological associations and other forms of advanced training can be obtained by the foster parent in the department of education at the place of residence.

When can a foster parent quit their job?

The agreement on the conditions of upbringing and support of children is terminated ahead of schedule in the presence of valid reasons:

On the initiative of the foster parent in the cases of:

- adoption of wards;

- Return of children to their parents for upbringing;

- at the request of the parents, if guardianship or custody over children is established at their request or with their consent;

- Provision of state support to children in children's boarding schools, institutions of vocational, secondary special, higher education;

- recognition of the guardian, custodian as incapable or partially capable;

- the occurrence of the guardian, guardian of diseases included in (the List of diseases in the presence of which persons cannot adopt a child, be foster parents, parents-educators is established by the Resolution of the Ministry of Health of the Republic of Belarus of December 15, 2017 No. 108);

- personal request of the guardian, custodian in the presence of valid reasons (illness of the guardian or custodian, change in the composition of the family, material conditions, lack of necessary contact with the ward, moving to another locality for permanent residence, etc.).

On the initiative of the guardianship and custody authority in the cases of:

- improper performance by the foster parent of the duties assigned to him;

- deprivation of parental rights of the foster parent or recognition of their children in need of state protection;

- The commission by the foster parent of an intentional crime established by a court verdict that has entered into legal force;

- The use by the foster parent of his position for personal gain, as well as in the case of leaving children without supervision and necessary assistance.

With the termination of the contract on the conditions of upbringing and support of children, the employment contract is also terminated.

All property and financial issues arising as a result of early termination of the contract are resolved by agreement of the parties, and in the event of a dispute - by the court in accordance with the procedure established by law.
