The primary form of placing orphans, children left without parental care for upbringing in a family is national adoption.

If adoption is impossible, orphans and children left without parental care are subject to placement in a foster family, a foster family, a family-type orphanage, and in the absence of such an opportunity - in boarding schools.

When adopting orphans, children left without parental care, placing them in a foster family, family-type orphanage, family ties, ethnic origin of children, belonging to a particular religion and culture, native language, the possibility of ensuring continuity in upbringing and education must be taken into account.

 Consideration of cases on the adoption of a child is carried out by the court in a special procedure according to the rules stipulated by the civil procedural legislation of the Republic of Belarus.

Cases on the adoption of children are considered by the court with the obligatory participation of the adoptive parents themselves, the guardianship authorities, the prosecutor, and in cases of international adoption - also with the participation of the National Adoption Center.

For the adoption of a child, a conclusion of the guardianship and adoption authority is required on the validity of the adoption and on its compliance with the interests of the adopted child, indicating information about the fact of personal communication of the adoptive parents (adoptive parent) with the adopted child.

The procedure for transferring children for adoption, as well as the procedure and terms for exercising control over the living conditions and upbringing of children in families of adoptive parents on the territory of the Republic of Belarus are determined by the Government of the Republic of Belarus.

The adoption is considered established from the date of entry into force of the court decision on the adoption.

The court is obliged, within three days from the date of entry into force of the court decision on the adoption of a child, to send an extract from this court decision to the civil registration authority at the place of the decision, to the guardianship and trusteeship body at the place of residence of the adoptive parents and the National Adoption Center.
